The general rule is that child support continues to be payable for an unmarried child who has turned 18 years old, so long as he/she is a full-time high school student and is not self-supporting, until the child completes the 12th grade or turns 19 years of age, whichever first occurs. If you have further questions, you should consult with a Family Law Attorney. Good luck.

When determining whether child support should be ordered, the court looks at whether a child is deemed to be emancipated. Emancipation can occur upon the happening of numerous events, including, but not limited to whether the child has reached the age of 18 but is still completing his/her studies. If a child has reached the age of 18 but is still in school, that child is not deemed to be emancipated and child support is typically ordered. Keep in mind that in Massachusetts a child may not be deemed to be emancipated until after they have completed an undergraduate program.

Yes. Child support is awarded to a child who remains dependent upon the parents. The language in typical child support orders read, "until the child turns age 18 or graduates from high school." Since the child is still in high school, child support should be paid. However, provisions should be made to address post-secondary educational expenses. If provisions are not made for doing so, the court may lose jurisdiction to make such an award later. You should consult with an experienced attorney.
