Will witness statements work in court for public intoxication? 2 Answers as of April 27, 2011

I got public intoxication arrest in Texas. I have a witness saying that I was not intoxicated to the level of hurting myself or anyone else. The witness says that the cop that arrested me went solely off a witness statement who happened to be an off duty detective. do I need people in court or can I use there witness statements?

You need people in Court. Witness statements are hearsay. You will want to object to the cops hearsay and force his witness to show up.
