Will social security affect my I-751 petition? 3 Answers as of February 06, 2011

I am getting social security disability benefit from my husband, does it affect on my I-751 petition of removing conditional status? Do I need affidavit of support from another person? We have 15 months old baby and our income is 20.000. Thank you.

You should be fine. You should focus on proving something else. Talk to a lawyer.

No, your receiving a social security benefit should have no affect on whether USCIS removes the conditional status on your lawful permanent residency. And, no, an affidavit of support should not be an issue.

You do not need an affidavit of support for an I-751 petition. The only issue on an I-751 petition is whether the marriage is bona fide.
