Will a past warrant for arrest affect approval of form I-130? 1 Answers as of March 21, 2011

My friend's father was deported this morning. He was supposed to be deported 4 years ago, but he didn't go so there was a warrant out on him. Now that he's been deported, my friend wants to bring him back legally. Will the past warrant affect his return to the U.S.?

If he was deported, he is subject to 10 years immigration bar. That's to say he is not admissible for 10 years starting from the day he was deported. However, depending on his case, he may be able to obtain a waiver for inadmissible. Obtain legal representation from a lawyer to help you with that. If you like, you can schedule a telephonic consultation with us to assess his eligibility for a waiver.
