Will my living arrangements affect custody? 6 Answers as of February 13, 2012

I currently have sole physical custody, ex has visitation but wants joint custody after 3 years. Will my living situation affect the courts decision? I live with my parents, using their house during the day and a large RV for a bedroom at night, with plumbing, heat, etc. The children have their own beds as well.

Living arrangements are considered by the courts. How old are the children. I would take pictures of the RV and have them available should the court ever want to see them. Were you living in the RV prior to the current order in place? I would argue that as long as the children are in a safe place and have their own room and beds the courts should allow that. You ex is going to have to show that joint custody is in the best interest of the children.

In general, living arrangements are not a big issue in a case like yours where you have had primary custody for a long time. However, the court does want to make sure that the children have adequate living arrangements. If you have a big RV and all the children have rooms and space it should not be a big issue.

If your ex brings up your living arrangements, you should be prepared to testify at the custody hearing, with photographs that you have taken which demonstrate the adequacy of your and the children's living arrangements, both in your parents' home and in the large RV.

Living arrangements are only one factor in determining custody. As for your question, it sounds as if you are dong the right things. If there were an investigation, the investigator would look to see that ther is sufficient food in the house, that things are clean and tidy, the children properly clothed and have their own beds, and that it is generally a healthy place for the children to be. That all being considered, after three years, your ex would need to show a Material Change in Circumstances for a change in custody.
