Will my husband be able to obtain a loan while I am going through a bankruptcy? 14 Answers as of November 29, 2011

I filed for a chapter 7 bankruptcy and have two vehicles. One I am surrendering and one I want to redeem. The vehicle I want to redeem is in my husband's name and I am the co signer on it. If I cannot receive a redemption loan, will my husband be able to obtain a loan while I am going through bankruptcy? He is not included in the bankruptcy as I filed individually. Is he free to do as he pleases without it affecting my bankruptcy? I have my meeting of creditors soon.

Your right to redeem will not impact your husband's obligation on the car loan. Your bankruptcy should not impact his credit if he continues to pay his debts including those that are joint.

I am really perplexed. You should not even be in bankruptcy without a lawyer, and you certainly should not be looking at redemption loans without experienced counsel. Since your assets all belong to your estate and not you, you cannot simply let your husband take over without taking certain legal steps.

The short answer is: Yes, your husband can get a loan while you are in bankruptcy. The more complete answer will involve a careful examination of your finances, but in nearly all cases the bankruptcy of one spouse need not affect the credit standing of the other spouse.

Your husband is free to do whatever he wants to about incurring debt while you are in bankruptcy. I can't say whether or not, he will qualify for a loan but there is nothing stopping him from trying.
