An 18 yr old was charged with rape in the second for having consented sex with a girl under age and he was not aware of it yet he confessed to having the sex before he found out her age. He has no criminal history or prior criminal charges of any kind

It is very foolish to have sex with a girl under 17, but it is even more foolish to talk to the police and confess to it. You are under an obligation to find out the age of a young girl before you get involved with her. You cannot take her word for it or just claim you did not know she was 16. Statutory rape is a very serious crime and if the man is older and the girl is under 14 there is usually a jail sentence possible. For an 18 year old and a 16 year old girl there is a good chance that a plea offer would be made with no jail time to the charge or a reduced charge with a Youthful Offender Treatment. You would not have a criminal record if the judge grants the YO.
