My husband had a daughter with another woman prior to our marriage, can she file child support against me in California?

She can seek child support from your husband. If he does not have sufficient funds to pay for support, then they would take it from community funds. They cannot use your income to make a finding of child support, however if your husband is unemployed, they can impute income to him and attach the community funds.
