Will I face jail time for fourth degree criminal mischief? 1 Answers as of May 03, 2011I was arrested on a 4th degree criminal mischief charge for damages to private property. I do not have a previous record and dont know what to expect in court. Do you think they will drop it to a lower charge and will I face jail time?

The outcome of the case depends on many factors including what was damaged, why it was damaged and the county you are in. However, with no prior record, it is likely something can be worked out - like plea to a lesser charge, or possibly a deferred sentence so you won't have a conviction at the end of the deferral time period, etc. I think it is unlikely you will go to jail.
