Will I be charged for a DUI? 2 Answers as of November 01, 2011

I got a charged with a dui in Pennsylvania, but I wasn’t taken to jail, or see a judge. I was taken to the hospital to have blood drawn and then taken home. I wasn’t given any paperwork and I still have my driver’s license. Can they or will they run me through the legal system?

In Pennsylvania you do not go straight to jail for DUI. They may hold you until you sober up or someone comes for you and then they release you. The charges are filed later and sent to you by mail. This can take a week, several months, or in the rarest cases up to two years. If you blood comes back over the limit you can rest assured you will get that paperwork in the mail.

You will probably get charged by Summons with a court date mailed for your Preliminary Hearing.
