He was already married but is now getting a divorced. If he gets married again before the divorce is final will he get deported his passport will expire in July? He was oringinally here on a visitors visa. Will they be able to tell if he gets married in Las Vegas that he was married before in New York, and will he be able to file for a green card? Will the person he marries go to jail?

It is a crime to be polygamous in the US and willful violators can and will be denied a green card. If he were to marry before his divorce is final, then the new marriage is null and void and will not count. These days the feds is able to find out if a person has been previously married in the US. If he lies in his immigration application, he will be denied and it will be very, very difficult for him to get another immigration benefit. So, be careful. I say be patient. He can marry and become a LPR even if his passport is expired. Besides, he can get another passport. Good luck!

Any marriage that occurs before a prior marriage is legally terminated is a void marriage and is not valid for immigration purposes. Additionally, intentionally marrying someone while you are still married to someone else is bigamy and a crime.
