Will a dismissed criminal charge be a problem in a tourist visa application? 7 Answers as of November 07, 2011

Will my Filipina girlfriend's tourist visa application be denied if I have a criminal charge that has been dismissed? Since I can't visit her due to an open case, I want her to visit me instead. I have been convicted on an assault charge and I'm on probation. Will that affect her chances of getting it approved if we disclose our relationship and her reason for the visit?

Your criminal history should have no effect on her tourist visa unless you have been convicted of a sexual offense that is covered by the Adam Walsh Act. Your girlfriend will have difficulty getting a tourist visa based on your relationship and the fact that she must demonstrate that she will return to the Philippines at the termination of the visa, Because she is in a relationship to you, there will be a presumption that she is coming to stay. However, the fact that you have a criminal case should not have an effect on her application.

Your charges will not affect her ability to get a tourist visa; however if it is known she is coming to visit a PR or USC boyfriend then she may have a problem with immigrant intent in other words because of her relationship with you they may not believe she intends to return to the Philippines. If she does not disclose your fiance relationship then she is committing immigration fraud. If your intent is to marry within 90 days after she get here then the more proper visa may be a fiance visa.

Your criminal offense does not carry any weight in the visa application process for her. So, go for it!

Normally a dismissed charge is not a problem since it is your case and not hers. The rest of your question contradicts the first part so I am not sure of the situation.

Your criminal history is unrelated to her nonimmigrant visa application.

The fact that you have a dismissed criminal charge will not impact your girlfriend's tourist visa application. As for whether she will be able to obtain a non-immigrant visa, the answer depends upon her ties to the Philippines. The best course of action is to be up front and honest with U.S. Embassy/Consulate officials. She will likely need to show substantial ties to her home country such as proof of employment or enrollment in school, family ties, lease or ownership of property, etc. The U.S. Embassy/ Consulate will not issue a visa if they do not believe she will return.

No, your record is not relevant for your girl friend's tourist visa application. What matters is her eligibility for the visa.
