USCIS has access to all state law databases. Making false statements to USCIS is a fraud, and it may subject you and your spouse to deportation.

If you are married, you must not state that you are single. If you are an intending immigrant, you must not enter the USA on a tourist visa.

You are free to marry anyone. The issue is whether you can obtain green card through your illegal immigrant. Your future application will be under extreme scrutiny. It is our advice that you should be cautious when you file application for yourself or your spouse based on marriage. You would be better off hiring a lawyer. Good luck!
