Why is a diversion class not an option after I shoplifted? 1 Answers as of June 28, 2011

I live in Iowa and I shoplifted at Kohls Department store in Omaha, Nebraska. I pleaded guilty to the charges and asked for a diversion program to get this taken off my record. This is my first offense and the prosecutor didn't allow me to have it. He did allow me to fill out papers to have a hearing to have the charge set aside. Why can't I be allowed to have a diversion class?

Most of the time diversion is an option on a first offense shoplift, but unless the amount was low they generally don't offer it to people in court. You should have hired a lawyer to enter a not guilty plea and then sought to plea bargain it to diversion.
