Who has rights to a house during a divorce? 1 Answers as of June 20, 2011

My cousin will be getting a divorce(nothing is in the works). Her husband wants her to move out of the house and into an apartment which he'll pay for. we don't believe him. He is having his sister, 3 kids and illegal alien baby daddy move in to help with their 2 daughters. We are worried that he is setting my cousin up. He says she can get the girls 2 or 3 days a week. Could he be setting her up for something like abandonment? Does she have to move out of the house? Thanks for your time and effort.

She does not have to move out of the house and it might be best for your cousin to file for divorce soon and request the judge order who has right to remain in the residence during the proceedings.
