If you are ever confronted by the police or any law enforcement agency you should ask to call an attorney and politely demand that all questioning stop until he arrives or they provide you with one. You should never waive your Miranda rights or sign a statement without the benefit of counsel. Young men seem to get into a lot of trouble and they seldom know their rights. They make matters much worse by making admissions or confessions. Don't cut your own hair, pull your own teeth, or act as your own lawyer. Remember, "Fish only get caught when they open their mouth." I cannot tell you if you will be arrested, but it would be a good idea to have a good criminal lawyer's card in your wallet. Just feel lucky you did not blind the pilot and crash the plane.

First, as a pilot myself, I want to say what you did was stupid beyond all reason, it is dangerous and downright ignorant. While I am unaware of any crashes resulting from lasers being pointed at planes, the potential for causing night blindness is extreme, these little cheap lasers are not designed to be safe to the human eye and there are known (reported) cases of night blindness - usually temporary - related to such incidents. The FAA has a special program on the subject right now and the NTSB in connection with NASA is doing studies on this subject right now. More importantly to you, it is a Federal violation as well as a State Crime. In other words, from a criminal defense standpoint, you screwed the pooch big time, this is a politically hot topic right now. The best you can hope for is the pilots do not press the issue or you are pulled into the study. On either of these, you will count yourself lucky. If you are prosecuted . . . . As for knowing when you will be arrested or even if you will be arrested, that is something that you just have to sweat out. The FBI or local authorities (whomever decides to prosecute) does not have to advise you of when the warrant is issued.

    I had one of the first cases of this violation that was prosecuted in Long Beach. That person was not arrested that day but was about a week later. This is a felony and as such there is a statute of limitations that starts running from the time of the incident. They may charge you any time within three years. However, if they are going to charge you with this it should happen within 8 weeks.

    First I must say that the conduct is very serious and you must never do it again. With that being said, I was young and reckless once to so I understand. There are various punishments for this conduct depending on whether you are charged in state court or federal court. The punishment in Federal court is five years in prison. California penal code section 247.5 punishes this conduct with a sentence to local jail or state prison for 16 months, 2 years or 3 years.

    You won't necessarily be arrested. You may simple receive a notice in the mail. For future reference, you have the right to remain silent. Use it!     1) Hire a lawyer to interface with the U. S. Attorney's office; Do NOT do this yourself. 2) Stop making statements to cops. In the history of the American criminal justice system it has never helped anyone and they will distort it to make you look guilty. 3) Remember, the police/prosecutors, etc are NOT your friend. They want to convict you. Never, never, never make a voluntary statement. It is perfectly legal to refuse to speak to them. However, if you tell them what they can construe as a lie that will get you busted.

    There is not enough information in your question to give you a complete answer. However, the basic answer is that they will sometimes give the chance to turn yourself in but most of the time they will just arrest you and you will know as it happens. Hire an experienced criminal defense attorney that does work in federal court (which is drastically different than state court).
