What would I have to do to have my mother from Germany live with us in the US? 15 Answers as of March 09, 2012

My husband is a retired military and we would like to make it possible for my 69 year old German mother to live with us here in the US. Is this possible? If so, what would we have to do?

You would need to file an I-130, "Petition for Alien Relative" to start. She will likely have to consular process, meaning that you will file the petitions and she will remain in Germany until called in for an interview at the U.S. consulate. The amount of time the process will take depends largely on whether you are a citizen or a lawful permanent resident (LPR) and priority dates if you are an LPR. I would also recommend you consult with an immigration attorney, as the process does have the tendency to get fairly complicated, epecially if your mother is subject to any bars of inadmissibility.

This is possible if you are a USC, then you can petition her. All she has to do is come to the US and once here she can file for an adjustment of status and just remain. The first thing I would want you to do is use a professional to do it if this is an important thing for your family.

What is YOUR immigration status in the US? Since you are the daughter, you would have to petition for your mother and not your husband. You would only be eligible to petition for your mother once you are a US citizen.

Assuming you are a U.S. citizen, you could petition for your mother to receive an immigrant visa. This would allow her to receive lawful permanent residence. However, if you are not a U.S. citizen, the first step is to become a citizen. Unfortunately, your husband cannot petition for your mother.

It may be possible. It sounds like your mother is a citizen of Germany. But what is YOUR status? Are you a U.S. citizen? A greencard holder? If you are a U.S. citizen, you can indeed petition (sometimes called "sponsor") your mother to come to the U.S. and live here as a U.S. lawful permanent resident-in other words, she would have a greencard. But let me ask a follow-up: does she really want to stay here permanently? If she'd like to visit for 90 days at a time, she seems to be eligible for a Visa Waiver, meaning quite easy to get on the plane and come see you. Longer term arrangements are possible. Go see a good, experienced immigration attorney near you. I think this is a very solve-able issue. Good luck!

You can file a petition for Alien relative Form I 130 for your mother with the United States Citizenship and Homeland Security. You will need to show that you have sufficient income to support her as you will eventually have to file an affidavit of support. Once the petition is approved, USCIS will notify the US Consulate in Germany and you and your mother will have to submit further documents. She will also have to go for a medical exam and an interview at the Consulate in Germany. The process will take at least 1 year before she gets her Green card and is eligible to live in the United States permanently.

If you are an United States Citizen then your mother is an immediate relative and the process is fairly quick and relatively painless. If you are not an United States Citizen then you and your attorney will need to find other options, though there may not be any, as there is no visa category for the parents unless except parents of U.S. Citizens

If you are a US Citizen then you would apply for her immigration. If not, you will apply for US Citizenship (so long as you have been on a Green Card for 3 years if the GC was from marriage or 5 years if you got the GC any other way) and then apply for her after you became a US Citizen.
