What will happen after breaking probation? 1 Answers as of May 19, 2011

A person was placed on non- reporting probation. Years had passed after, the probation date has expired and the fine was not paid. Can a judge violate a person probation? Then upon violating the probatio , can the judge take the fine from the defendant and sentence the defendant to a prison term?

If the violation of probation was filed in court before the expiration date of the probation, you can be arrested at any time for the VOP, and sentenced to prison or any other penalty under the law, as if you never had gotten probation in the first place. However, if no petition to violate your probation was filed before the expiration date, you cannot be violated at this late date, in my opinion.
