My license was suspended due to a DUI accident in 2006. I owe my insurance company $7,000. I setup payment arrangements with them in order to get my license back but the promissory note they want me to sign is unfair. They claim they will not reinstate my license until I sign. What can I do?

Check with other insurance companies for comparison. You should contact DMV and inquire what is required in your particular case. In general, completion of alcohol school, license suspension served, insurance, etc.

You need to work out a payment plan in order for the DPS to allow you to get your dl back. The insurance company needs to get a hold of the DPS and lift the hold on your dl. You can contact the dps and see if there are any other options or if there is another reason your license is revoked.

Your insurance company does not reinstate licenses; the state; specifically, the Secretary of State's Office does. Further, you may owe the state driver's responsibility fees or other costs. I'd recommend you retain a lawyer who handles driver's restoration matters to assist you. You need someone to carefully review your driving record and sort through your possible suspensions or revocation. Speaking generally, you may be need to file a request for reinstatement with the Secretary of State and may need representation at a hearing before the Driver's Assessment and Appeal's Division as well. Further, you may need to prove your sobriety at this hearing. Simply paying off your insurance company, while it may be a useful step in the process, may not be enough to get your license back. I'd recommend you retain a lawyer to help you with this matter.

You don't say what is in the promissory note. Since you are making time payments, the note can assess interest on the unpaid balance. This is generally 12% per annum. Besides the promissory note obligation, I suspect that Department of Licensing is also going to require you to have SR22 insurance. This is high risk insurance and can be expensive. Also, have you complied with all the terms imposed upon you by the court? Do you need to have a guardian interlock device on your car? I suspect that you probably do. The only way I can answer your question is to see the court judgment and the promissory not. Without either, I cannot advise you and can only speculate. You need to retain an attorney.

    Your insurance company does not issue driver's licenses. The secretary of state does. You should contact the secretary of state to see what you need to do in order for them to issue you a driver's license. An attorney may be able to help you with this.

    You probably need an attorney to re-negotiate your obligation. With an outstanding judgment the DMV can withhold your license. It is not the promissory note but the court judgment that is your problem.

    I do not know or understand how you owe your insurance company any money. Were you insured at the time of the accident, with liability insurance? Maybe you mean that you were uninsured and the other party in the accident had insurance that paid him off, and is coming against you at this time. The best place to begin is with the DMV or Secretary of State's office. See an informal hearing officer who can check your record and tell you straight up what you need to do to reinstate the license, do not take the word of a third party, who may be defrauding you. However, if it turns out that you made an agreement with the other driver's insurance company, and blew them off, because you felt the amount was unfair, you are out of luck and must repay the insurance company before you can reinstate the license.

    The insurance company has no control over the reinstatement of your license only the Department of Motor Vehicles of the state. You are eligible for reinstatement of your license once the period of suspension is over and you have current proof of SR 22 insurance.     Drinking and driving is like firing a gun at a moving train and hoping no one gets hit by the bullets. DWI is a serious crime in New York and your insurance will dramatically increase. You are lucky that you did not injure or kill another driver or yourself. I do not know what your contract with your insurance includes, but you should retain an attorney to handle the situation and advise you. Your insurance company does decide when you can apply for a license, DMV does. You do however need insurance from a company in New York State in order to drive a car. If you apply to another insurance company the rates will be outrageous since you have a DWI conviction and therefore you are a in a risk pool. Making bad decisions is very costly in life, try not to make any more.

    First of all, whether you pay off your insurance company is completely irrelevant to whether you can get your license back. You can obtain SR-22 from any insurance company, not just the one you were using back then.

    I have never heard of an insurance company reinstating your license. After a DUI, all you need to do to satisfy the DMV's requirements is to take the DUI Safety Treatment Course and pay your reinstatement fee. Your insurance company should have no part in it.

    If you file bankruptcy it will likely eliminate the need to repay, and in many circumstances, you will be able to get your license re-issued. You may be required to carry SR 22 though.
