What is the statute of limitations for my case? 1 Answers as of February 13, 2012

About 7 years ago my wife whom was pregnant in the very early stages was sick with flu like symptoms went to the Doctor and ask for something to take for her condition. Prior to her being prescribed medication my wife told the Doctor she believed she was pregnant and didn't want anything that would harm the baby and the Doctor prescribed her a level 5 antibiotic that killed the baby. My wife had a D&C and sure enough there was a baby. Is it too late to pursue this loss or should and can we pursue a possible law suit?

I believe that you case may be barred by the statute of limitations which is typically 4 yrs in such cases; however, you may want to seek a full legal consultation to be sure.
