What should I do if I am being investigated for unemployment fraud? 2 Answers as of December 30, 2011
I have claimed unemployment since last year when I was laid off. They called me back in but on per diem and I failed to report any earnings. I did reply honestly that I have not worked more than 4 days or earned more than the amount listed which was 405.00 per week. I cannot answer what the unemployment office may or may not do after they complete the investigation. You will have to wait and see. you should hire an attorney if after investigation is over they bring negative consequences.

You may have committed a felony and should retain a good criminal attorney to investigate the matter. You should not talk to any investigators, police officers, or others or answer any questions. If they have you arrested you will have to have your attorney advise you to either plead guilty or go to trial. You probably knew that you answered the questions falsely in order to gain some advantage and that was a mistake. It may also be a felony and you could have a criminal record and pay restitution but will probably not be facing a jail sentence.
