What is the penalty if convicted of aggravated assault? Posted on July 08, 2011

My brother-in-law is an illegal immigrant in Georgia. He was charged with aggravated assault in 2005 in Florida as the result of defending himself agasinst a robbery. He never went before a judge on the charge ~ he was deported instead. He came to the US illegally and was picked up on 6/9 in an immigration raid (wasn't committing any offense) and has been at the Atlanta Detention Center since then. He was told that they were not going to pursue the charges and that he would be deported. Is he eligible to come back to the US legally and, if so, could he face prosecution for those old charges?
