What happens when a minor breaks their probation? How? 3 Answers as of September 07, 2015

A friend of mine (16) was on house arrest for a DUI with no license so she was put on house arrest with her license suspended. She got off arrest and was still on probation. Same day she was arrested for underage drinking. What will the punishment be? The cops were saying about locking her up. If so how long? Is there any way she can just do more house arrest time? What are her options?

To a large extent that depends on her probation officer. It also depends on her history of compliance or noncompliance with the rules. She may expect something harsher than she likes. But she's really got to follow the rules if she wants to stay out of further trouble.

She is at risk to be re-sentenced up the maximum sentence of the original charge, which in this case should be three years in prison. She needs to be represented by an attorney to make the best case for her to avoid incarceration.
