What happens now that all the Trustees have discharged himself? 4 Answers as of January 31, 2012

Can this have any affect on my garnishment on his payroll check for my maintenance? I am almost 63 and am on disability. His money helps pay the mortgage on the family home I had to remortgage. Ex wife filed chapter 13 and did not pay the trustee. I am now getting phone calls from his bill collectors!

If you are also legally liable for the debt, then yes, the creditors can also come after you for payment. If that is the case, you might need to consider filing bankruptcy as well.

Your disability or social security income can not be garnished. If your name is on the mortgage, then you are still liable for the debt and will continue to get phone calls from the debt collectors.

It sounds like the case was dismissed, if so then you may want to look into filing your own bankruptcy if you had joint debt. You should consult with an attorney.
