What happens if my injuries worsen after the case? 1 Answers as of November 05, 2010

I won my personal injury case for a car accident and the other party covered my medical bills. However it is now 5 months later and suddenly I feel that the pain has returned and I have already scheduled more hospital visits. Will I be able to do anything about this or is it too late?

Generally, once an injured victim has signed a release and officially "settled" their personal injury claims, they are prohibited from pursuing any further claims regardless of the condition of those injuries. This is especially true if the victim was represented by counsel; however, if the victim receives nominal consideration for the settlement and is not represented, the claim may be re-opened in certain circumstances. If you were represented, call your attorney to discuss your concerns and/or obtain a second opinion from another attorney after fully discussing the facts of your case.
