You may be assuming that the insurance company is ignoring the dismissal by the DMV, however, they may be acting on the DWAI conviction! Consult your insurance agent or an attorney. The criminal conviction is reported to DMV and will show up on your driving record. Just like a speeding ticket, etc. I don't see anything that is happening wrong here. Sorry.
