What is the difference between a 401K and K1 Retirement? 2 Answers as of August 01, 2012

My husband's business doubled and tripled during our marriage but he says there are no marital assets to be divided in our divorce case. All we have is the corporate and personal taxes. Do I need a forensic CPA to audit in order to find out what happened to all of the money? He will not comply with mandatory disclosure.

You have asked complicated questions, except for the first one. There is no such thing as a K1 retirement. The term is a 401(k) plan, which is a section of the Internal Revenue Code. If your husband refuses to provide his Mandatory Disclosure, file a Motion to Compel Discovery and ask the judge to order him to produce everything. As for the forensic accountant, it sounds like you need one.
