The man is guilty of statutory rape and consent is not a defense. Such a conviction often carries registration as a sex offender. The only possible defense is ignorance of the girl's age. Clearly, however, not everyone who is guilty of this offense is prosecuted. The offense must be reported to the police before charges will be brought.

If it can be proven that the 27 year old man is the father then he could be prosecuted for unlawful sexual intercourse with a minor, which can be a felony as well as misdemeanor child molest.

If he was not more than ten years older than her, it could be filed as a misdemeanor, however it still could be filed as a felony. If girl does not want to testify against him in court she cannot be forced to.

Assuming this is brought to the attention of the police or the prosecuting authorities, they are likely to file what used to be called "statutory rape" chargesconsensual intercourse with a minor greater than 3 yrs apart in agea felony.

The adult faces potential felony charges of statutory rape, sexual assault, sexual molestation, among others, several of which result in lifetime registration as a sex offender. Of course you can fight the charges. When arrested or charged with any crime, the proper questions are, can any evidence obtained in a test, search or confession be used against you, and can you be convicted, and what can you do? Raise all possible defenses with whatever admissible and credible witnesses, evidence, facts and sympathies are available for legal arguments, for evidence suppression or other motions, or at trial. If you don't know how to do these things effectively, then hire an attorney that does, who will try to get a dismissal, diversion, reduction or other decent outcome through plea bargain, or take it to trial if appropriate.

There are a number of different charges that can result. 261.5 (unlawful intercourse) as well as any "foreplay" offense such as oral copulation, digital pentration etc. Also beware that under the law getting a minor pregnant is considered GBI and can be an enhancement. I strongly suggest you consult with an attorney ASAP.

There are a number of felony charges that can be filed against the adult. Most would require lifetime registration as a a sex offender. There is also case authority that getting the minor pregnant is great bodily injury. This would make any offense to which that charge connected a violent felony requiring any prison time to be served at 85% of the sentence. Consent is not a defense. Minors cannot legally consent.
