You do not qualify for Chapter 13 bankruptcy if your secured debts exceed $1,081,400 or your unsecured debts are more than $360,475. If you do not qualify for Chapter 13 because of these limits, Chapter 7 is a possible alternative.

The unsecured debt limit for non-contingent, liquidated debts is presently $360,475. Most courts require you to include the amount of any junior mortgages that are wholly unsecured (i.e. where the value of the property is less than the amount owed to the first mortgage) in the unsecured total. However, you need to check with a bankruptcy attorney in your area for those specifics.

The unsecured debt limit for chapter 13 is currently $336,900.00. If you are over the limit and you want to reorganize you have to file chapter 11, which is more complex and expensive. Consult with an experience local bankruptcy attorney.
