My husband and I have not been able to pay a mortgage payment on a rental property for the last 15 months. The lender did not foreclosure but agreed to a deed in lieu paid in full with no decency. This would be a blessing except for: We allowed the tenant occupying the home to stay so that it would look lived in to prevent vandalism. We never collected rent and now states we have no right to make him leave. In addition the investor wants us to paint, put new carpet, and install window air conditioners as well as new locks. We informed the tenant he had to move and he refuses claiming it is his and we cannot afford to do all the things the investor is requesting. Where do we start and what right do we have over the tenants’ long stay w/o pay in our home?
