What can I do if there was a misclassification of exempt status by my employer? Posted on June 09, 2011
My boss told me on Tuesday I was my job classification was being changed from salaried exempt to hourly non-exempt because I was misclassified - I am an accountant. My job duties have not changed. He also told me that exempt status did not start until next week because he did not want to pay OT this week. Is this legal and am I entitled to back pay for being misclassified and working 50+ hours a week?
