If it is fraud, the IRS would be interested if there was fraud taking place. In this instance, the person claiming your kids likely has the right to do so.

File your return claiming the kids. The IRS will then be forced to determine who is entitled to the dependency exemption. But before doing anything make sure you are entitled to the dependency exemptions.
