What can I do if I made a mistake on my settlement agreement? 1 Answers as of July 29, 2011

I made a mistake (not realizing) signing a settlement agreement not to pursue further legal action, or pursue other cases with defendant firm. I had another case pending at the time of signing the settlement agreement. Is there any way to get out of the general release or have the language changed not to bar my pending 2nd case before the preliminary hearing?

It all depends if you were represented by counsel at the time of signing the settlement agreement. If you were, you will most probably be barred from undoing it. If you weren't, you can argue that you aren't a lawyer and that you were tricked into waiving your rights.
