What can I do if I do not have the financial means to pay for PC 1000 enrollment fees? 5 Answers as of December 05, 2011

I was ordered by the judge to do Drug Diversion class, part of PC 1000 classes. However I do not have the money for enrollment, due to financial hardship. I am currently homeless, and do not have any type of employment. I had already asked for a reinstatement for extension once. Second time I was to be present in court I did not go due to the fact I still did not have the money. I ended up getting a bench warrant in which I was arrested for the warrant recently. I asked my Public Defender if he could ask the judge to mandate me into a MFI inpatient recovery program. But all the judge said is this is my last time in showing proof of enrollment for my next court date. Otherwise I am looking at 3 years prison time. I do not know what I can do to prevent this. I did however put myself on the MFI Program waiting list. If I was to pay $25 for a letter from the program indicating that I am on a waiting list. Will that be sufficient enough to get the judge's approval until next court date?

You have an attorney. You need to contact your public defender to help you with this. PC 1000 enrollment fees are based on ability to pay. If you are penniless the fees should be waived. Otherwise someone has determined you have the ability to pay something. This needs to be your highest priority.

Go back to the court. Ask the clerk to put you matter on calendar and ask the Judge if you can extend time to complete PC 1000 due to lack of money for fees. The Judge may even suggest other options. But do complete it especially if your non-citizen. Good luck.

You do not want to fall out of the PC 1000 program. This is the very best deal that you can get when charged with a drug related offence. Get the money somehow. If not show up in court with your letter and see if the judge will accept that. And never miss a court date.

This is a tough situation. Unfortunately, you are not alone. There are sooo many people in your situation, and there are so many fines/fees/penalty assessments tacked on to any violation now - many of which are mandatory, meaning that our legislators have told the judge he has to impose them even if he doesn't want to! But I digress; this angers me. This doesn't help you in your situation. I do not know why the judge did not order you to a program that doesn't charge you, or why, if you do not have the ability to pay, the judge did not make that finding and order that fees for such program were waived. Why didn't or can't your public defender ask the judge? You should not be "penalized," violated, or denied the benefit of the law because you are down on your luck, so to speak. I would get you on the judge's calendar and ask just that! Hope you succeed and get the help you need and that things turn around for you.
