I have a contract with a woman to build a deck for her. The contract has a failure to pay clause. There is no guarantied completion date. She has not kept up with the payment schedule. I was supposed to get a check on Friday June 17th, it was raining, so I told her she could give it on Tuesday when I came back. She is a week and half over due on her payment schedule. I would like to cancel the contract and tell her to have someone else finish the job. Can I tell her she is in breach of contract and move on? This is in Massachusetts.
