What can be done if my father is threatening to beat up my mom if she sends us back to our country? 8 Answers as of January 09, 2012
My mom and I are immigrants. My mom wants to send my siblings to Mexico, but my dad said if she sent them he won't return them. He also gave the threat that if we return to Mexico he would by all means look for us and beat my mom. If he could not find us he would take it upon our family members. What can be done to protect our family?Free Case Evaluation by a Local Lawyer!

You may have rights to self-petition on the basis of abuse. It is best to consult with an immigration attorney who can review the whole situation and advise what protection can be obtained to keep your Dad from hurting you or your Mom.

If your parents are married and your father is a permanent resident or US citizen, your mother and all her children that are here without status may qualify to apply for status in the US without your father knowing. It is done anonymously. If your parents are not married and your father has not status in the U.S. there are still remedies for your mother and her children to obtain status in the U.S. I will recommend that if in danger, your mother files for an Order for Protection and consult with an immigration and family law attorney as soon as possible because time is of the essence. Also, I will recommend your mother or siblings do not return to Mexico because there are more protections in the US for all of them.

If this is serious, you need to report it as domestic abuse to local police. If the police determines that the claim is legitimate enough to prosecute your father, your family will be able to stay here legally.

Call the police. This is not an immigration issue really. IF there are threats and you think that he will act on them, you should contact the authorities.

Your question is bit unclear. You or your mother should call the police if there is any danger to your life. In terms of immigration status, or issues, please consult with an immigration attorney because I'm not sure what relief, if any, your seeking under immigration laws.

This is way too complicated to answer over the internet. The options depend on everyone's immigration status, why you need to return to Mexico and a host of other issues. You should consult with an attorney. Like many attorneys we will sit down and review your situation with you without charge. Your best bet is to find a good lawyer who provides advice on this kind of issue on a regular basis and review your specific facts; the lawyer will be able to give you an analysis of the law and your options.

If your mom is being threatened by your dad, who is a US citizen or legal resident of the US, your mom may be able to get immigration benefits under VAWA. She should talk to an immigration attorney who specializes in VAWA cases.
