What are some noneconomic factors considered in accidental death? 1 Answers as of November 05, 2010

Due to what we think is a misdiagnosis by the doctor my father was extremely ill and passed away recently. We are suing for personal injury and I was wondering what noneconomic factors we should consider when we present our case such as devastation, loss, etc. that might provide us with more compensation.

The type of non-economic damages in a wrongful death claim depend on numerous factors and could include: pain and suffering, loss of consortium/society, punitive damages etc . . . and these damages also depend on the dynamics of the family as well. Please keep in mind that Ohio places a very short time limit in which you may pursue a medical malpractice claim. You should consult an attorney immediately to investigate the claim to determine whether or not there is a viable cause of action. If there is one, then you can determine whether or not to pursue it.
