What are the possible effects of my 3 DUIs in getting a fiancé visa for my girlfriend? 10 Answers as of January 30, 2012

Will I get approved for fiancé visa if I have 3 DUIs in the past, because I’m trying to get my girlfriend here in US? I just want to know if I get approved, because I’m worried about my 3 DUI, if it will affect the status for the fiancé visa.

Generally, the petitioner or person sponsoring the fiancee's criminal history is not an issue therefore your 3 DUI should not matter.

If the DUIs are for the US citizen petitioner, it will probably not make any difference in your fiance visa petition so dont worry.

It does not but however, I recommend you quit drinking and driving to be safe and keep your future wife and your community safe.

If you are a USC over 21 and you have seen your girlfriend in person in the last 2 years, then I see no problem. Your I-129F will be approved if there are no issues on her side of things.

This will be an issue. The I-129f application states you cannot file a K1 if you have had 3 incidents related to alcohol or drugs (not from one incident). This may be waived, but you need to document it and read the I-129f instructions carefully.

Your criminal record should not have any negative impact on the fianc visa petition. There are some instances where a criminal conviction will be the basis for approving a fianc visa, but those are typically situations where the U.S. citizen poses a danger to the beneficiary such as individuals with domestic violence or sexual offenses.
