Drug trafficking is very dependent on the amount or weight of the drugs and also who is doing the charges. Likely the person would be charged by either the state that caught the person or by the federal government. The penalties can be extremely severe and if this is an actual situation the person should contact an experienced criminal defense attorney to assist this person with their current situation.

IF you are with a known heroin addict knowingly transporting a schedule I narcotic, you can be jailed just like the addict for 5-10 years.
