We rent an apartment that does not have a heater installed. Are we required to still pay rent? In doing a little research I came across health and safety code 1941.1 which states that "all rental properties must be furnished with a working heating element capable of maintaining a 70 degree temperature in the home at all times." So, do I have to pay rent if that minimum health and safety issue is not met? And also, what are my rights regarding rent I have already paid on this property which does not meet the minimum standard?
