I was sued by a junk debt buyer for a charged off credit card. I was not married at any time from when I signed the card holder agreement or when I was sued, but I got married in a CP state while the litigation was pending and before the final judgment. My fiance and I signed a prenuptial agreement which specifically stated that each party was not responsible for the others debts incurred before marriage, and that any assets, wages, or income that occurred after the marriage would be community property. Can I claim my wages are community property, the community is not impaired since it was formed after the debt was incurred, therefore my wages are exempt from garnishment?
