What are the laws regarding sex offender residency restrictions? 1 Answers as of July 15, 2011

My husband must register as a sex offender. Accusation was made May 2004. Took a plea. No jail time, seven years probation with required treatment (Tarrant County) and community service. He has completed all requirements. Is listed as moderate risk, indecency w/ contact. Are we under all the residency restrictions in Texas? Do they no longer apply since requirements were completed? We own a home in Dallas County but would like to purchase a home in South Texas. Will we have trouble buying or with HOA's?

There are no residency restrictions on registering sex offender who is not "on paper" - parole or probation. All of the rules governing your husband terminated with his probation EXCEPT registration. I do not see why you would have trouble buying a home - that is between you and the lending company. As for the HOAs, they may not like having a sex offender in their neighborhood but they cannot legally prohibit it (to my knowledge.)
