ICE has 48 hours to transfer the individual, however, a significant number of detention facilities now serve as ICE detention facilities as well. If this person is detained it would be wise to retain an immigration attorney.

Ice has 48 hours to "hold" you. If ice does not take custody of you during this time, you should be released from local or state custody.
