What can I do to get my son back from his grandmother who claims I'm on drugs and went out and partied while with my son? In her court order she made so many false accusations about me. I do not know how to defend myself in this case. I relapsed once, regretted it, wrote about it in my personal diary. She found it, copied it and used it in her report. All the letter says is that I messed up. I won't do it again. I need to take care of my postpartum depression that was killing me inside. I am a convicted drug felon. Before my relapse, I was clean for 18 months. I've been clean for five months since that relapse. The court is required to look out for the safety and welfare of your child. If you are clean and sober, provide proof of that to the court and the other side by resetting the matter or hearing. Agree and pay for random drug testing as a way to restore your custodial relationship to your son.

You need to go to court. First, you need to have a period of time in which you can prove you are clean. Second, go back to court and ask to have your rights restored.

You really need an attorney to take this to the court. It is a difficult process to rehabilitate yourself when it comes to custody of children, and you want to get it right the first time. If you cannot afford an attorney, appeal to a Public Law Center or Legal Aid in your community.
