Can my daughter be allowed to live in the country legally? 4 Answers as of February 20, 2012
My daughter had a brain tumor 2 years ago and went through an operation which left her disabled and partially blind. We are non immigrant. Is she en-titled to anything? Is there anything in place so that she can live in the USA legally?Free Case Evaluation by a Local Lawyer!

She can live in the US legally as long as you, her parents, are in the US legally as she is your dependent. IF you are nonimmigrants, I am presuming that you or your spouse would be pursuing permanent residence through employment. If so, your daughter would be eligible for permanent residence along with you as long as you get that prior to her turning 21. If you do not pursue permanent residence, there is no basis for her just to reside in the US lawfully despite her disabilities.

Sorry, your daughter does not get to live in the US because of her illness. She will still need to go through the normal visa petition process and will require a sponsor.

I am so sorry to hear about your daughter's tumor. I am sure that is devastating. There is an option for a B-2 for medical purposes if you can show the medical care is not available in her country, that there is a doctor here willing and able to take her on as a patient, and that you can pay for the medical care without applying for U.S. public benefits.
