Will spousal support affect my unemployment benefits? 2 Answers as of January 03, 2012

I am going to be divorced and will be receiving spousal support but I am also receiving unemployment benefits. Will those benefits continue once I start receiving the spousal support and should that amount of unemployment be considered when deciding on the amount of spousal support to be paid.

You will continue to receive Unemployment Benefits while you receive Spousal Support, but your Unemployment Benefits will be considered in determining the amount of Spousal Support that you will receive.

Your spousal support order will be based on a computer calculation which will include your unemployment benefit income and the income of the other party. Unemployment incomes takes the place of your job income. So, no you will not lose that benefit.
