If your case was dismissed with an ACD the mugs and prints would be destroyed or mailed to your attorney. If you plead to anything else you will have a conviction for a violation such as Disorderly Conduct and your prints and mug shots will remain in Albany and with the FBI forever and the conviction and arrest information will be available on the NYSID and federal computer system. You cannot get them back and New York does not allow expungement. The actual file with the papers and accusatory instruments may have been sealed if your attorney made that motion and it was granted, but the rest of the information is searchable.

You can make a request to Albany to get them returned to you. They should have a form online to do this.
