Co-owners of property share all of the rights and responsibilities of ownership. You are entitled to occupancy but so is he. You should work out a fair agreement between you as to how you will share the expenses of the property and how you will compensate him if you are going to exclusively occupy the property. Then write down your agreement and you both sign.

You seem to be 1/2 owner. So if you have not agreed to rent it out (and you get half the profits) they you have the right to occupy it solely. If he disagrees, you are entitled to stay anyway if you pay him 1/2 the value of rent. Otherwise you will have to got to court to sell and divide the proceed of the sale.
