Will someone who has a class 10 felony charge surely going to jail? 2 Answers as of February 21, 2012
My soon to be ex is a bigamist and will get the case next week. I know that is a class 10 felony, but he already has a felony theft charge on his record. Plus he swore under oath that he could get married and lied to the courts. Felony charges are sentenced by combining the actual charge with the person's prior criminal record. Most times a severity level 10 would expect probation.

Going to Prison for a level 10 State felony in Kansas is NOT necessarily what is going to happen. There are other probable outcomes. Yes, his past criminal history will indeed impact his sentence. It will enhance the length of any prison time. Additionally, if he is currently on probation for a felony, prison is a significant likelihood.
