My ex husbad wants to use an old bill to force me to let him claim our son. Can he do that? My ex husband and I have an old light bill that also has my sister's name on it. Under federal law, only the parent with primary custody is allowed to claim a child on their taxes. The non-custodial parent can claim the child only with the written permission of the custodial parent. What your ex-husband is doing (threatening suit unless you relinquish your legal right) could be considered blackmail.

Child custody and support matters are wholly separate from bills and other debts. You say he is your ex-husband. Presumably there is a current order as to child custody and visitation in place. Only a court with proper jurisdiction can modify the terms of that order.
